General terms and conditions of business

1. Scope

These General Terms and Conditions apply to contracts for the rental of holiday apartments from

to guests and for all related services and deliveries provided by the lessor. Any deviating terms and conditions of the guest shall not apply unless their validity has been expressly agreed to in writing.

2. Conclusion of contract

1.     By making a booking (via the website, a booking portal or by email), the guest makes a binding offer to the landlord to conclude a rental agreement.

2.     The contract is concluded as soon as the landlord confirms the booking in writing or in text form.

3.     If the content of the booking confirmation differs from the content of the booking, the contract is deemed to have been concluded with the content of the confirmation.


3. Rental period and arrival/departure

1.     The holiday apartment is rented for the period specified in the booking confirmation.

2.     Arrival is on the agreed day from 4 p.m., departure by 10 a.m. but no later than 11 a.m., unless otherwise agreed in writing.

3.     Overstaying the departure time may result in an additional charge for another day.


4. Prices and terms of payment

1.     The prices agreed upon at the time of booking apply. These include statutory value added tax and all ancillary costs, unless otherwise stated.

2.     Upon conclusion of the contract, a deposit of 100% of the total amount is due (advance payment).

3.     Additional costs (e.g. electricity, water, heating) are included in the rental price. Conserving resources is important to us. Therefore, additional charges may be applied if consumption is unreasonably high. The average per capita consumption in private households in the United Kingdom according to the United Kingdom Office for National Statistics is used for this purpose. Additional consumption will be charged at the local rates.


5. Cancellation by the guest

1.     The guest may withdraw from the contract at any time prior to arrival. The date of receipt of the notice of withdrawal by the landlord shall be decisive.

2.     In the event of cancellation, the landlord is entitled to reasonable compensation according to the following scale:

·        up to 30 days before arrival: refund of the total price minus cancellation costs, e.g. by payment service providers

·        29 to 14 days before arrival: 50% of the total price minus cancellation costs, e.g. by payment service providers

·        13 days or less before arrival or no-show: 100% of the total price

The guest reserves the right to prove that the landlord has incurred no or only minor damage. The landlord will endeavour to rent the flat to another party.


6. Withdrawal by the landlord

1.     The landlord is entitled to terminate the contract for good cause, in particular if:

·        force majeure or other circumstances beyond their control make fulfilment impossible. In this case, the rent already paid will be refunded immediately.

No refund shall be made if:

•        the apartment was booked on the basis of deliberate misrepresentation of essential facts,

•        the apartment is used for purposes other than residential purposes in the sense of a holiday apartment,

•        serious violations of the house rules occur.

In the event of termination during the stay, a pro-rata refund is excluded.

2.     Further claims are excluded.


7. Use of the holiday apartment

·        The apartment may only be occupied by the number of persons specified in the booking confirmation.

·        Pets are only allowed in apartments where this is indicated. A maximum of three pets are allowed in the approved apartments.

·        The guest undertakes to treat the flat and its contents with care and to report and replace any damage caused during the rental period without delay.

·        Smoking is prohibited.

·        Particular attention is drawn to the observance of quiet hours and waste separation. In the event of culpable disregard of waste separation, the landlord may charge for any additional costs incurred.

·        The landlord's house rules also apply. Serious violations may result in termination of the contract.

·        A detailed guest information folder is available in each holiday apartment. We ask you to take note of this, as it contains valuable tips and answers many potential questions.


8. Liability

1.     The advertisement has been created to the best of our knowledge. We accept no liability for any impact on the rental property due to force majeure, power and water outages customary in the country, or severe weather. Likewise, no liability is accepted for the occurrence of unforeseeable or unavoidable circumstances, such as official orders, sudden construction work or disruptions due to natural and local conditions. However, the landlord is happy to assist in resolving any problems (as far as possible).

2.     The tenant is responsible for their own arrival and departure. The tenant is fully liable for any wilful destruction or damage.

3.     Liability for items brought onto the premises is governed by the statutory provisions.

4.     Parents are liable for their children.


9. Data protection

The personal data provided by the guest will be used exclusively for the purpose of executing the contractual relationship. Data will only be passed on to third parties if this is necessary for processing the booking (e.g. payment service providers). The landlord's data protection declaration applies in addition. For security reasons, online check-in with personal details and contact information is mandatory prior to your stay. We process this data in accordance with the GDPR.


10. Final provisions

1.     Photos and descriptions provide a realistic overall impression. Minor deviations (e.g. replacement of furniture with equivalent items) do not entitle the guest to a reduction in price.

2.     Amendments or additions to the contract must be made in writing.

3.     German law applies. Mandatory consumer protection regulations of the country in which the guest has their habitual residence remain applicable.

4.     The place of jurisdiction for legal action against entrepreneurs is Stuttgart.

5.     Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
